Govt may approach SC to relocate MCD toll points away from Delhi’s borders

New Delhi: Govt is looking at approaching the Supreme Court to seek relocation of collection points for MCD’s entry tax and green cess away from Delhi’s border with Gurgaon, Faridabad, Ghaziabad and Noida as they have become a source of perennial congestion and traffic jams.
Road transport ministry officials told a parliamentary committee on transport and tourism on Thursday that they would urge the court for relocation of the cess collection points beyond the immediate borders to provide relief to commuters.
Sources said some members of the panel led by JD(U) working president Sanjay Jha raised the issue of jams at borders on NH-48 (Gurgaon), DND Flyway (Mayur Vihar) and Meerut Expressway (Ghazipur), which caused huge inconvenience to commuters. The issue is more acute at the Delhi-Gurgaon border of NH-48 and the DND Flyway. The snarls at some of these points is a daily affair during rush hour or at night when trucks enter the national capital.
While GST resulted in the removal of entry taxes at state borders across the country, the cess on commercial vehicles ordered by the SC to combat air pollution in the capital is being collected at Delhi’s entry points.

Responding to questions and steps that the ministry and NHAI are taking to address this, a senior ministry official told MPs that the collection of environment compensation cess (ECC) by the Municipal Corporation of Delhi (MCD) was the main cause for congestion at the borders.
While taxis and trucks are mandated to have a pre-paid instrument, drivers often avoid recharging them and end up paying cash, adding to the chaos. Since the process of collection and settling the cess through MCD’s RFID tags are different from the NHAI’s FASTag, the two have not yet been integrated. The MCD has issued around 10 lakh such smart tags to commercial vehicles for collection of cess.
Besides, the private agency that collects ECC and entry fee as part of an outsourcing deal has placed barriers — and also parks its vehicles — in the middle of the road to stop vehicles.
“The (ministry) official informed that since following SC order, the Centre and Haryana govt have built the Eastern and Western Peripheral Expressways, which work as bypass for Delhi for vehicles, and now there is a strong case to approach the apex court to shift the location of the ECC collection points beyond the immediate borders of Delhi and its neighbouring cities,” a source said.
Sources told TOI that the transport ministry is likely to convene a meeting of top officials from Delhi govt, MCD, Gurugram Metropolitan Development Authority, Noida Authority and Ghaziabad Development Authority very soon to discuss the issue and prepare a strategy.
They said in the past six years, there have been several attempts to find a way out for integrating the system of FASTag and MCD’s RFID tags to collect ECC and entry fee, but not much progress has been made. The sources added that the MCD has also approached SC seeking a single unified value for ECC, which would pave the way for integration of the system for faster processing.
