Notice to MCD, police, traffic dept on plea to remove squatters around Tis Hazari courts

New Delhi: A Delhi court on Tuesday issued a notice to MCD, Delhi Police and traffic department while hearing a petition urging the removal of encroachments and illegal occupation of public roads and footpaths around Tis Hazari courts.
According to the plea, several trucks and transport services engaged in “unauthorised” loading and unloading of goods in the area, causing severe traffic congestion, obstruction of pedestrian movement and disruption of the professional duties of advocates.
Not satisfied with the status report filed by the SHOs of Kashmere Gate and Sabzi Mandi police stations, the court of additional sessions civil judge (ASCJ) Rinku Jain asked all the respondents to file a detailed status report by March 26, the next date of hearing.
“The reply to be filed by defendants 1, 2 and 3 (MCD and the two SHOs) shall also mention the complete details of vendors operating around Tis Hazari courts, specifically how many have been granted tehbazari licences and what action has been taken against those operating illegally. Defendants 2, 3 and 4 (the SHOs and DCP traffic) shall also file a status report regarding the commercial vehicles/heavy vehicles running during the restricted entry time,” said the judge.

In his petition, advocate Devender Dhiryan said in the last few years, illegal encroachments, traffic congestion and unregulated activities have soared within a 1km radius of Tis Hazari courts and its surrounding areas, including GT Karnal Road, Lala Hardev Sahi Marg, Hamilton Road, Raj Pura Road, and the Mori Gate Chowk-Saint Stephen Road stretch, among others.
The plea alleged street vendors unlawfully occupied the roads and footpaths in these areas and hawkers and shopkeepers had encroached the public space to sell their products, causing severe inconvenience to pedestrians who were forced to walk on the roads. This, said the petitioner, increased the likelihood of accidents and obstructed the free movement of vehicles.
The roads were further obstructed by the illegal parking of vehicles, including tempos, trucks, e-rickshaws and private cars, causing frequent traffic jams and contributing to air pollution, said the petitioner. Commercial vehicles’ loading and unloading activities were routinely conducted in the middle of the roads, exacerbating congestion and creating an unsafe environment for commuters, he added.
The lawyer said these issues had severely disrupted the access of judges, advocates, litigants and the general public to Tis Hazari courts, hindering the function of the justice delivery system and infringing on the fundamental right to access justice.
